Federal judge rules against American Airlines in 401(k) ESG lawsuit
ESG DiveVictor Flatt, the Coleman P. Burke Chair in Environmental Law and the associate director of the Burke Center for Environmental Law, discussed a federal judge’s ruling that American Airlines violated its fiduciary duty to loyalty in a class-action lawsuit over alleged ESG conflicts, while upholding its prudence. Flatt noted the ruling may shield some findings from appeals. “This frames legal questions as factual determinations, complicating review,” he said.
