Panera restaurants pull Charged Lemonades from their menus in the wake of lawsuits

Florida Record: Sharona Hoffman, the Edgar A. Hahn Professor of Law and co-director of the Law-Medicine Center, discussed allegations that Panera Bread engaged in false advertising related to its lemonade drinks. Hoffman described what a plaintiff would need to prove to be successful in a false advertising lawsuit. “Merely ‘puffing’ or boasting about the qualities of the product does not constitute false advertising,” she said.
