Hahn Professor of Law and co-director of the Law-Medicine Center, said that because of medical ethics guidelines—as well as the Health Insurance Portability and Accountability Act—a GOP-led committee may not extract many details in their investigation into former President Biden’s use of the autopen. “Unless Biden authorizes disclosure, his physician simply can’t speak about his health conditions,” she said. “HIPAA absolutely applies, and that is a right that Biden himself has.”
