Hahn Professor of Law and co-director of the Law-Medicine Center, and Andy Podgurski, professor of computer science, discussed regulatory approaches to artificial intelligence (AI) in the healthcare sector. AI defects can disadvantage certain groups of patients, they note. To address discrimination concerns and ensure appropriate use of AI in medicine, Hoffman and Podgurski recommend creating a private cause of action for disparate impact cases, passing legislation on algorithmic accountability, and including algorithmic fairness in the FDA’s oversight standards.
