Defense of Marriage Act faces widow’s tax case appeal

Bloomberg News: A U.S. appeals court in New York is set to consider arguments challenging the Defense of Marriage Act. “The main issues in these cases revolve around equal protection, the idea that this federal law treats similarly situated people differently,” said Jonathan Entin, the David L. Brennan Professor of Law, who believes the final decision will rest with the U.S. Supreme Court.
