Law’s Jonathan Adler weights on in Federal Trade Commission rule proposal

FTC intends to ban noncompete clauses that bind 30 million US workers
ARS TechnicaJonathan Adler, the Johan Verheij Memorial Professor of Law, weighed in on a Federal Trade Commission rule proposal prohibiting employees from imposing noncompete clauses on workers, arguing that “non-competes constitute an unfair method of competition” and therefore violate Section 5 of the Federal Trade Commission Act. “This proposed rule sets up (a) potential legal challenge to the scope of FTC authority to issue substantive rules,” he said.
