Federal agency powers in the crosshairs at the U.S. Supreme Court
U.S. News & World Report: Jonathan Adler, the Johan Verheij Memorial Professor of Law, said trouble may await federal agencies that overstep their constitutional authority—particularly after a slate of recent U.S. Supreme Court cases curbed their power. “It’s harder for the court to rule that the agency’s composition or funding mechanism is unconstitutional without declaring a lot of what the agency has done to be illegal,” he said.
