Supreme Court limits power of EPA, other regulatory agencies

Wall Street Journal (subscription required): Jonathan Adler, the Johan Verheij Memorial Professor of Law, said the Supreme Court case stripping the EPA of its power to regulate is a warning to regulatory agencies that they should be wary of interpreting old laws to give them broad new powers. “Finding dormant regulatory authority in pre-existing statutes is something the court disfavors,” Adler said.
