Appellate court decision on Cleveland tow truck law champions city’s ‘home-rule’ power
The Plain Dealer: An Ohio appeals court ruled that a state law unconstitutionally limits Cleveland’s right to regulate tow truck operators, a victory for the “home-rule” authority of cities. How the Supreme Court will rule, though, is up for debate. “The court has said that there are limits to home-rule, and in particular areas the city’s power has to give way,” said Jonathan Entin, David L. Brennan Professor of Law. “But this looks like the kind of issue that the Ohio Supreme Court might actually agree is within the city’s home rule power.”
