Further evaluation needed to determine if Bionca Ellis is ‘incompetent to stand trial,’ judge says

WEWSMichael Benza, professor of practice at the School of Law, discussed the mental competency of a woman accused of fatally stabbing a 3-year-old boy in a North Olmsted grocery store parking lot. “Competency looks at today,” Benza said. “Is she able to do this? Not guilty by reason of insanity looks backwards to the time of the crime. Was she capable of controlling and understanding at the time of the crime? So that issue would have to be explored.”
