Attorney General rejects petition to end qualified immunity
Spectrum News: Michael Benza, professor of practice at the School of Law, discussed a political effort to get a proposal on next year’s ballot seeking an end qualified immunity. The legal doctrine protects state and local officials—including law enforcement officers—from individual liability unless the official violated a clearly established constitutional right. “As a general matter, qualified immunity serves a very useful purpose,” Benza said. “Completely eliminating it would probably wreck a significant amount of havoc in our governmental entities.”
